Yesterday: “It is likely that the Republican majority will try to soft-pedal this until Miers, voluntarily or not, withdraws her own nomination after suffering a thousand cuts.”
I would have shared that sentiment had the Senate actually fulfilled its Constitutional obligation to block a crony like Miers, Josh, but there is a chance that she would have been confirmed. There is a chance that Miers actually knew that she not only had a massive uphill battle to fight in the Senate for confirmation, one that would have embarassed the president, but that she was wholly unqualified to sit as an associate justice on the Supreme Court. If that is the case, let us assuredly toast to her good sense.
